Insensitive as it is, private business and obesity isn't a protected class.

I think it is unfair to discriminate against fat people as there is a genetic component to obesity. I know of "skinny" people who eat like a pig and never gain any weight. i also know of obese people who eat very little. That guy is a jerk to tell that girl she is too fat. I hope he gets it all back some day.

However, my assessment still stands. Obesity isn't a protected class and this is a private establishment i.e. he can dictate activities in his place of business.
