As you probably know, I was tried in 2003 for providing marijuana starter plants to medical marijuana distribution centers. The exact charges were manufacture, providing a place to manufacture and conspiracy. The jury found me guilty on all three felony counts.

Within four days of the trial eight of the jurors repudiated the verdict. After leaving the jury box they learned the whole truth. They had not been allowed to hear that I was appointed as a City Officer empowered to provide patients with medical marijuana. Jury members told the media that they felt that they had been used and worse. One of the jurors revealed that she had consulted a lawyer about the trial while she was a juror.

After considering all the facts of the case the judge sentenced me to one day in prison, time served. I appealed the convictions on three grounds: improper actions by the juror, the fact that I was a city officer should have exempted me from prosecution under federal law and that even if I was not protected I had been led to believe I was by proper authorities and thus should be free from prosecution under the rules of estoppel, that is, when a person is advised by the government that his/her actions are legal, they shouldn’t be arrested even if the individual was ill-advised.

Americans for Safe Access ([Only registered and activated users can see links])

Americans for Safe Access (ASA) is an aggressive media and grassroots campaign designed to force Attorney General Ashcroft and the Bush Administration to back off its anti-medical marijuana campaign and to grant states the right to choose and govern medical marijuana laws. ASA will work to prepare and defend medical marijuana dispensaries and the patients they serve from attacks by the Bush administration through legislative strategies, media campaigns, and non-violent direct action.

Osburn Defense Fund ([Only registered and activated users can see links])

This case is bigger than Lynn and Judy. Unlike other medical marijuana cases, the Osburns, in conjunction with the LACRC, met with local, state and federal officials in making every effort to implement Prop 215 legally. The lawyer who advised them was also a local elected official. The Osburns paid federal and state income taxes on all moneys received as reimbursement for their costs and services. Everything they openly disclosed to public officials the federal government is now using against them.

National Organization for the Reform of Marijuana Laws ([Only registered and activated users can see links])

NORML is a nonprofit, public-interest lobby that for more than 30 years has provided a voice for those Americans who oppose marijuana prohibition. NORML represent the interests of the tens of millions of Americans who smoke marijuana responsibly and believe the recreational and medicinal use of marijuana should no longer be a crime.

Drug Policy Alliance ([Only registered and activated users can see links])

Drug Policy Alliance is the nation's leading organization working to end the war on drugs and promote new drug policies based on common sense, science, public health and human rights. The Alliance, headquartered in New York City, maintains offices in California, Washington, DC, New Mexico, and New Jersey.

Marijuana Policy Project ([Only registered and activated users can see links])

The Marijuana Policy Project works to minimize the harm associated with marijuana -- both the consumption of marijuana, and the laws that are intended to prohibit such use. MPP believes that the greatest harm associated with marijuana is prison. To this end, MPP focuses on removing criminal penalties for marijuana use, with a particular emphasis on making marijuana medically available to seriously ill people who have the approval of their doctors.

Media Awareness Project ([Only registered and activated users can see links])

DrugSense and its largest project MAP combine to form a 501 c3 non-profit corporation. MAP exists to provide accurate information relevant to drug policy in order to heighten awareness of the extreme damage being caused to our nation and the world by our current flawed and failed "War on Drugs." MAP aims to inform the public of the existence of rational alternatives to the drug war, and to help organize citizens to bring about needed reforms.
