JUDGE WILL ISSUE TEMPORARY INJUNCTION IN AMP CASE
Late Friday afternoon a U.S. District Judge indicated that the court would issue a temporary injunction to delay the implementation of the AMP rule promulgated by CMS. According to the judge, lawyers representing NCPA and NACDS proved irreparable harm to over 10,000 community pharmacies if this rule were implemented. The Judge’s temporary injunction will be issued on Wednesday, December 19th. The injunction could be as short as 30 days or as long as 6 months. All indications show that CMS will appeal this ruling. So the story continues…
Pharmacists now face a new problem: Congress is already saying that because of this court ruling, they (Congress) do not have to do anything given this court action.
